Terms/ Conditions/ Deposit
The Booking
Your contract is with the Floating Surf Resort. Hereinafter called (Floating Surf Resort, We, Our, or Us). These booking conditions together with the details on our website form the basis of your contract with us. When booking a stay, a contract is made when we confirm the booking in email. The person who is making the booking and signing the booking form (hereinafter called 'you' or 'the client'?) accepts responsibility for payment for everyone listed on the booking. You are also responsible for ensuring that all other persons listed on the booking form read these booking conditions and are fully aware of these booking conditions. All participants must complete the attached waiver and sign before they will be allowed to stay. The Floating Surf Resort does not accept any liability for any loss caused by failure to complete the waiver.
Payment
A deposit of $300 USD per person is due at the time of booking. The remaining balance is due two months before the trip starts. If you book less than two months before the trip, the full balance must be paid at the time of booking. Final reminders are not sent and if the balance is not paid prior to the trip we reserve the right to re-allocate or cancel the booking. We will always attempt to contact you prior to taking this action.
Changing your booking
We will try to accommodate changes without a fee for bookings with at least two months notice. Subject to availability. Any changes after that are subject to the penalty in the 'Cancellations' section below.
Cancellations
If any named person or you on the booking form need to cancel the booking once it has been confirmed, we must be notified by email. The date on the sent email will determine the level of cancellation charges applicable. Charges will be levied at the following percentages of total course cost:
Percentage of cost payable
60+ days before the start date of your trip - no penalty
45-59 days before the start date of your trip - 25% of total trip cost
30 - 44 days before the start date of your trip - 50% of total trip cost
15-29 days or less before the start date of your trip - 75% of total trip cost
<15 days before the start date of your trip - 100% of total trip cost
In the event that our surf resort is unable to operate due to external factors out of our control (being due to weather, political, legal, or other factors) we reserve the right to cancel all existing reservations.
Liability
The activity of surfing carries with it a degree of risk both to people and property. Many recreational activities may require strenuous exercise and various degrees of skill and experience. In addition, water conditions may be hazardous, dangerous and unpredictable. You understand that serious injury to the person and damage to property may result. You must also understand that these risks, hazards, and dangers are further increased when other persons, whether of the same level of experience or skill or not, are using the same facilities. You further acknowledge and understand that no amount of care, caution, instruction, experience, or expertise can eliminate the dangers associated with land and water activities, and that the location in Indonesia and at remote surf breaks increases the dangers, hazards and risks. You assume the risks, hazards, and dangers of personal injury, death, and disability inherent therein. You acknowledge that you have been advised to take all available precautions during your stay, including while engaging in recreational activities. You acknowledge that you are aware there will be no supervision. You voluntarily, expressly, and irrevocably assume any and all such risks. You release all claims/indemnity/agreement not to sue. In consideration for the services and accommodations provided by Floating Surf Resort, You hereby agree to release and forever discharge Floating Surf Resort, its principals, agents, contractors, employees, officers, directors, trustees, affiliates, parents, subsidiaries, successors, assigns, licensees, and all other persons or entities on its behalf (collectively, “Affiliated Parties”), from any and all claims, actions, damages, liability, costs or expenses and attorneys’ fees which are related to, arise out of, or are in any way connected to my/my minor child’s stay with Floating Surf Resort or use of Floating Surf Resort services, boat or equipment rentals, or participation in recreational activities, whether or not such activities are organised by Floating Surf Resort, and whether or not such claims, actions, damages, liability, costs or expenses are caused by the negligence of Floating Surf Resort. You agree to hold harmless and indemnify Floating Surf Resort and its Affiliated Parties from any and all liability for damage to any third party resulting from my/my minor child’s stay with Floating Surf Resort and/or participation in recreational activities. You intentionally surrender and waive any right to sue or exercise any legal right to seek damages from Floating Surf Resort or its Affiliated Parties.
Surf Conditions
The surf conditions vary. The waves can be perfect and friendly or dangerous. We are not responsible for any surf conditions. You are advised to evaluate the conditions before paddling out. We do not guarantee perfect waves.
Accommodation
The Floating Surf Resort has private rooms, surf viewing and sunning decks, common area with dining tables, comfortable chairs, wifi., hammocks, canoes, and snorkel gear. Rooms have fans and air conditioning, comfortable beds, and mosquito nets. Shared Bathroom.
Pricing
All pricing is confidential between the Floating Surf Resort and the client. Prices are set at the beginning of the year and occasionally special discounts will become available. All prices agreed through email at the time of deposit will remain the same.
Law and Jurisdiction
These conditions form a contract between us which will be construed in accordance with Indonesian Law and it is agreed between us that each will submit to the jurisdiction of the Indonesian Courts.
Floating Surf Resort Rules
Quiet time: 10 pm - 7 am
Respect: all Guests, Locals, and other Visiting Surfers
No Nudity: This includes underwear and mens bikini thongs
(Girls Are allowed to wear bikinis and swim wear)
No Drunken Behavior: Stay in control. Respect the Locals. Safety first.
No disrespectful or rude people.
No illegal drugs.
No waterskiing or surfing behind the boats.
That's about it. We are easy going...just want you and everyone to have a fun and safe trip.
